1. Who provides the service

KoolTranscribe is provided by ERC IMPLEMENTORS LTDA, CNPJ 12.353.398/0001-29, São Paulo, Brazil ("we"). Contact: admin@erc-implementors.com.

2. The service

You upload an audio or video file and receive its text (a transcript) as TXT, SRT or VTT, produced automatically by a speech-recognition model that runs on servers operated by us. Transcripts are generated by software: they may contain errors and are not a certified or legal transcription.

3. Minutes, packs and plans

  • Transcription is paid in minutes. One minute is charged for each started minute of media, with a minimum of one minute per file.
  • Minutes are charged only when the transcription succeeds. A failed transcription costs nothing.
  • Packs (300 and 1000 minutes) are valid for 12 months from the day they are credited. The monthly plan credits 1000 minutes that expire 31 days later; order again each month.
  • New customers receive a one-time free allowance. We may change it for new customers at any time.
  • Files are limited in size and length (shown on the upload page).

4. Prices and payment

Prices are shown in the currency of your region. Payment is by bank transfer to the account shown at checkout, using the order reference. Minutes are credited when we confirm that the payment arrived, usually within one business day. Invoices are issued in Brazilian reais; if you are quoted in another currency, the foreign amount and the exchange rate used (Banco Central do Brasil rate of the invoicing day) are stated on the invoice. For customers abroad we also issue a proforma invoice in your currency. The service for a customer abroad is an export of services and is invoiced free of Brazilian taxes.

5. Cancellation and refunds

If you are a consumer in Brazil you may withdraw from the purchase within 7 days of paying, as long as you have not used the minutes (Consumer Defense Code, art. 49), and we will refund what you paid. Otherwise unused minutes can be refunded on request within 7 days of the purchase; minutes already used and expired minutes are not refunded.

6. Your content and your responsibilities

You must have the right to upload and process the files you send, including the consent of the people who speak in them where the law requires it. Do not upload unlawful content or content that violates other people's rights. You keep all rights to your files and transcripts; we only use them to provide the service to you.

7. Confidentiality and data

Your file is deleted from our servers as soon as it has been transcribed. We do not use your files or transcripts to train models. How we handle personal data is described in the Privacy Policy.

8. Availability and liability

We try to keep the service available but do not guarantee uninterrupted operation or error-free transcripts. To the extent allowed by law, our liability is limited to the amount you paid for the minutes concerned. We may suspend an account that breaks these terms.

9. Changes and law

We may update these terms; the version in force is the one published on this page. They are governed by Brazilian law, and the courts of São Paulo/SP are competent, without prejudice to the consumer's rights where they apply.
